Provider

These terms are between you and KH Global Group LLC, the provider of the BuildPenny app and of this website.

What the product is, and is not

BuildPenny is a record-keeping and calculation tool for construction project finances. It stores and totals what you enter.

• It is not a bank, a payment service or a money transmitter. It does not move money.
• It is not a tax, legal or accounting adviser. Tax rates and figures are aids you configure.
• It does not verify that work was done, that a contractor is insured, or that a payment is correct.
• It does not convert between currencies. Totals that would mix currencies are withheld.

Licence

Your use of the app is licensed, not sold. Unless a custom end user licence agreement is presented with the app, Apple's standard Licensed Application End User License Agreement applies, together with the App Store Terms of Service.

Your responsibilities

• Your data is yours. You own the records you create. Keep your own backups: if you delete the app, or a project, without a backup, the data is gone.
• Keep your device, your Apple ID and your backups secure.
• Use the app lawfully, and enter only information you are entitled to hold.
• Check figures before you rely on them for a payment decision.

Price, purchases and refunds

The current price is shown on the App Store. Any purchase is made through the App Store, and Apple handles billing and refunds under its own terms. Nothing here removes or limits the consumer rights you have by law.

Availability and changes

The app is available in the countries where the App Store lists it. We may add, change or remove features, and we may update the app and these terms.

The app works offline. This website may be unavailable from time to time for maintenance. Material changes are described in the app's release notes.

Intellectual property

The app, this website and their design remain the property of the provider. Your records remain yours.

Limits

The app is provided as is. To the extent the law allows, the provider is not liable for indirect or consequential losses, or for decisions you make based on figures you entered. Nothing here excludes liability that cannot lawfully be excluded.
